5.1 Your Data

You retain ownership of all clinical trial documents and data you upload to the platform ("Customer Data"). By uploading data, you grant TrialAmicus a limited license to process that data solely for the purpose of providing the Services to you.

5.2 Data Isolation

Your Customer Data is stored in isolated environments and is never used to train shared AI models or shared with other organizations. We implement strict technical and organizational measures to ensure the confidentiality and integrity of your data.

5.3 Confidentiality Obligations

Both parties agree to maintain the confidentiality of the other party's proprietary information and to use such information only as permitted under these Terms or a separate written agreement.

6. Intellectual Property

The TrialAmicus platform, including its software, algorithms, user interface, and all related intellectual property, is owned by TrialAmicus and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in our platform or technology.

You retain all intellectual property rights in your Customer Data. By using our Services, you do not transfer any intellectual property rights to TrialAmicus.

The information provided through our Services is for informational and decision-support purposes only. TrialAmicus does not provide medical advice, regulatory guidance, or legal counsel. You are solely responsible for all clinical decisions made in connection with your use of the Services.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIALAMICUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
